Subject: Before the next AI licensing call: define the event that earns your money

Preview text: Recent access and payment announcements give publishers a useful negotiating question: what, precisely, gets measured and paid?

AI Training Data Licensing Research | 4 November 2026

The decision this week

Before approving a new AI content proposal, ask both sides to write down the same transaction in plain language: who gets which material, what they may do with it, what triggers payment and what evidence the owner receives.

If those answers differ between the sales presentation, technical plan and agreement, resolve the difference before handing over an evaluation sample. A promising platform is not a substitute for an agreed product.

Recent development: usage is a proposed billing event

Cloudflare announced its Pay Per Use beta on 30 September 2026: buyers define offers for specified uses, publishers choose participation, and buyers report usage for settlement. The announcement distinguishes downstream use from charging for a crawl. Read the announcement.

Your action: ask for one sample usage record and one settlement statement. Have finance explain how the first becomes the second. Your diligence should cover missing reports, disputed events, corrections, retained evidence and the party responsible for resolving differences.

A separate route for request-based products

Also on 30 September 2026, Cloudflare announced a closed-beta Monetization Gateway for charging agents for resources such as APIs, tools and datasets. Its announcement limits initial availability to eligible US-based buyers and sellers. Read the product announcement.

Your action: decide whether you are selling a discrete request, a reusable content permission or an ongoing feed. Use that answer to scope a pilot. Do not apply a per-request price mechanically to an archive that can be copied and reused under broader permissions.

One document to bring to the meeting

Prepare a proposed transaction schedule with these fields:

  • Content cohort and version.
  • Contracting customer and authorised downstream recipients.
  • Permitted use, reserved uses and retention terms.
  • Payment trigger, rate basis and any deductions.
  • Evidence fields, reporting date and reconciliation owner.
  • Dispute route, stop conditions and responsibilities after termination.

This is a working checklist for commercial and legal review, not a standard-form agreement. An unresolved field should become an assigned question, not a silent assumption in a forecast.

The question to ask a prospective partner

“Can you demonstrate the complete path from a permitted content event to cash received by an owner with a comparable archive?”

A redacted, permissioned example can be enough to evaluate the process. If the supplier cannot share one, record the limitation and agree an alternative test. Keep evidence of a functioning payment process separate from any claim that your own archive will attract demand.

Next step: use the Partner Scorecard on the proposal in front of you, then reserve a small preparation budget only after the next decision and its evidence requirements are clear.
