Subject: October AI licensing digest: reporting moves closer to the centre of the deal

Preview text: Publisher coordination and telemetry deserve attention; the practical test remains whether your own agreement can be reconciled.

AI Training Data Licensing Research | October 2026 review, prepared 4 November 2026

What changed in October?

The useful question for a content owner is becoming more concrete: can a counterparty show what happened to the content after access was granted? This month's selected developments concern that reporting problem and publisher participation in shaping the market.

2 October: SPUR explains its reporting framework

SPUR's 2 October announcement presented its Content Telemetry framework and described work on implementation and proofs of concept. Separately, the standard's own site dates version 1.0 to 2 September 2026; the announcement and specification dates should not be conflated. Why it matters to your next agreement: a shared vocabulary can make reporting requirements easier to discuss. Ask your prospective partner to map the evidence it can supply to your actual commercial terms. If its reporting does not answer the question your invoice depends on, a standards reference in a presentation will not close the gap.

13 October: more publishers join SPUR

The coalition's own 13 October update names The New York Times, AFP, The Economist and The Atlantic among new members. It reports more than 80 members across over 20 countries. Those are coalition-reported participation figures, not numbers of paying AI buyers. Read the original update.

Why it matters to your shortlist: ask which protocols a supplier actually implements, at what version, and with which counterparties. Membership, an intention to implement and a tested production workflow belong in separate columns of the diligence record.

Carry-forward context: marketplace proposals still need archive-specific qualification

Microsoft's 3 February 2026 Publisher Content Marketplace announcement described a pilot for licensed grounding content, publisher-defined terms and usage reporting. Treat it as evidence of a route to investigate, rather than proof that your archive is eligible or commercially attractive. Read Microsoft's announcement.

This older item is included as background, not October news. Before spending on integration, request current participation requirements and confirm the proposed use against your existing products and licences.

Three checks for the month ahead

Owner Recommended check Decision it supports
Commercial lead Obtain one written, archive-specific use requirement from each serious route Whether demand warrants a controlled evaluation
Legal lead Review how the proposed reporting and retention terms relate to permitted uses Whether the agreement can be approved or needs revision
Finance and data leads Walk a sample event through calculation, invoice and receipt Whether reporting is usable in practice

What we still cannot tell you

These announcements do not establish a universal content rate, typical owner income or the probability that an ordinary archive will sell. Do not replace missing evidence with a headline from another publisher's transaction.

The next useful request is specific: “Show us what a comparable owner could verify after delivery.” If no evidence is available, the appropriate response may be a bounded pilot, a narrower permission or a pause.

Next step: build a rights matrix and a remittance reconciliation worksheet for your current proposal, with unresolved items assigned to named colleagues before the next supplier meeting.
