What changed that should affect an AI licensing decision now?

The most useful change is more precise evidence about particular uses, transparency duties and data-handling obligations. None gives a publisher automatic authority to license every item in its archive, and no single AI case creates a universal answer about fair use.

For an imminent mandate or sample release, prioritise three checks: identify the exact use; show the rights available for each content cohort; and identify who will receive, retain and reuse the material. A contract reviewer needs those facts before evaluating broad assurances about legality. The statutory fair-use assessment considers purpose, the work, the amount taken and market effects; it is not a blanket exemption based on the label “AI”. 17 U.S.C. §107.
