The primary xAI order describes California Civil Code §3111 as requiring covered developers to publish high-level dataset documentation, including source, type, intellectual-property and personal-information characteristics. That is a duty directed at the relevant developer; selling content alone does not automatically make the owner that developer. 4 March court order.

The court subsequently stayed district-court proceedings pending appeal, which is not the same as enjoining the statute. 23 March order. The current appellate disposition was not conclusively verified in this pass; obtain it before relying on any claim that enforcement has changed.

Contract response: decide how the dataset may be described publicly, who approves accuracy, how corrections work, and how legally required disclosure interacts with confidentiality. Prepare a metadata sheet without automatically supplying raw confidential files. Ask the developer which disclosure requirement it is trying to satisfy; do not grant broad downstream rights merely because it requests transparency information.
